Maintenance Plans Made for Your HVAC Needs in Columbus, Dublin, and Delaware OH

1. This agreement covers materials & labor for routine maintenance only. Material and labor for replacement component parts, emergency repairs, and any other non-maintenance related projects will be billed separately on a time and material basis. Major repairs will be quoted for your approval prior to performing the work.
2. Custom Air Technicians are scheduled to perform maintenance during normal working hours (Monday through Friday: 7:30 am to 4:30 pm) unless requested otherwise by the client. In such cases, Custom Air technicians will be billed at current over time rate minus plan discount. If scheduled beyond normal working hours at Custom Air’s request, no overtime premium would apply.
3. Custom Air will provide 24-hour support for any of your systems that are not running properly. All troubleshooting and repair work will be billed to you based on the time and materials needed at our standard rates less the labor discount % per your Maintenance plan. Service calls on weekends, holidays, and after regular business hours will be billed at overtime rates (minus the % labor discount per your plan).
4. Custom Air shall have no liability under this agreement: for any structural alterations to the premises necessary for maintenance; for any default, delay, or damage caused by any circumstance beyond Custom Air’s control including lighting strikes, fire, power outages or supply problems, acts of God, labor strikes, or inability to obtain necessary materials or products; for any consequential damages of any nature; for system’s design or installation and its performance in maintaining desired operating conditions; for any work to utilities or ductwork.
5. Services to be performed under this agreement are not a guarantee against obsolescence or normal wear, nor shall there be construed any approval or guarantee of the condition of equipment covered by virtue of this agreement.
6. Cleaning of evaporator coil is not included. The need to clean the evaporator coil can vary greatly due to a variety of specific conditions (quality of fuel, age of equipment, filtration methods, system design and conditions, air quality, etc.).
7. Custom Air will not typically reimburse clients directly for any claimed damages. For any claims whatsoever, client must provide Custom Air representatives and their insurance company complete opportunity of due diligence to inspect any potential direct physical damages to client’s property BEFORE corrections or repairs are made. Custom Air will also not be responsible for, and will be held harmless by client, for indirect damages of any kind, such as but not limited to: client opportunity and revenue loss, failure of client’s ability to perform due to Custom Air actions or lack thereof, third party impacts and claims, etc.
8. This annual agreement commences upon receipt of your payment and will continue thereafter until either party chooses to cancel upon a thirty-day written notice to the other party. This Maintenance Agreement will automatically renew for successive one-year (1) terms unless either party provides written notice of its intent not to renew the agreement at 30-days prior to the expiration of the current term. Payments for uncompleted visits will be the property of Custom Air if the undersigned chooses to cancel during the agreement period (maintenance time and materials required will vary per visit and thus accurate pro-rating is impossible).
9. Custom Air shall have no liability or responsibility under this agreement while any invoice is more than 30 days past due. Once past due accounts for any additional services are paid, this agreement will resume independent of the additional services and payment. Payment for additional services is due within 30 days of invoicing of such. A finance charge of 1 ½ % per month will be apply on all past due accounts, representing an annual rate of 18%.
